Article I: Establishment
I. Herein established shall be the Esamir Penitentiary System, or EPS.
II. The EPS shall consist of one maximum security prison for the incarceration of individuals found to be in violation of supranational laws.
III. The EPS shall be administered by the United Nations of Esamir and shall not be under the control of any single nation.
IV. The governing body of the EPS shall be the International Court of Justice.
V. No entity save the International Court of Justice may incarcerate an individual in the EPS.
Article II: EPS Location and Administration
I. The EPS shall be located on the uninhabited island west of the Eurasian Colony of Bruma. This land shall be declared property of the UNE.
II. Those incarcerated therein shall be given all the basic necessities as is required by international law.
III. Funding for the construction of the EPS shall be undertaken by all member-states of the General Assembly.
IV. The guard contingent shall be initially made up of members of the UNEPF, however once the completion of the EPS is finalized the guard contingent shall consist of rotating groups of soldiers of the UN member-states.
V. Nations unable to provide soldiers for the EPS contingent shall provide either clothing and medicine or police forces with similar training.
VI. The island on which the EPS resides shall be considered property of the UNE.
Article III: Transferral of Current Prisoners
I. Any individual convicted by the International Court of Justice of war crimes, crimes against humanity, or similar charges shall be transferred from existing national facilities to the EPS.
II. The UNE will financially provide for the transfer expenditures.
Article IV: Miscellany
I. The International Court of Justice shall be responsible for the EPS administration.
II. Nations unable to provide adequate funds shall provide other means of production.
